The child as a solitary case or as the center of a relationship in Greek jurisprudence on medical liability for wrongful birth cases, presentation at the 1st National Conference of Medical Ethics and Bioethics, Aristoteleian University of Thessaloniki, December 8-9, 2017

Greek jurisprudence is rich with decisions on medical liability for wrongful birth. Older jurisprudence sustained that since a child has been already been born at the time of the suit, there can be no compensation, as there can be no lawfully recognized damages for the birth of a person-life can be no damage. In parallel, the criminal law secured a pregnant woman’s liberty to opt for the abortion of a genetically defective fetus. Whereas the choice of this termination rests with the woman, recent jurisprudence declared that both parents may sue if this decision was not rendered possible, due to defective medical advice on the fetus’s genetic defects. The result is a contradiction: the child is seen in the law as both the ‘object’ of a solitary decision by the mother (criminal law on abortion), and also, as the ‘object’ of a common decision, resting upon both parents (tort law of damages).The presentation aims at explaining this contradiction and will present the reasons, and the way, to alleviate this asymmetry in the law for reasons of justice and equal satisfaction of competing interests.
